Prior eval posted where others can read it

    A prior bad evaluation of mine was posted on the district computers where other teachers could read it. Likely by the principal who gave it to me.

    I have the union looking into it, but does anyone know if laws were broken and specifically which one? The principal isn't with the district anymore, but I want to pursue it based on principal.

    Also, please tell me, you are all appalled and shocked too.....I am passed shocked I am in total disbelief, thank God I found it and not anyone else......

    Just when I thought that crap from last year was behind me....

    I can't believe that! I would definitely think it would be against a law and I would talk to my union rep about it.

    Brendan, its the title of the document.

    Yes the union is involved, I just wonder what law was broken and what can be done about it....

    Unbelievable. In what context was it posted? Of course evaluations are supposed to be confidential.
    I am so sorry that this happened. You have my sympathy, and I hope your union has your back!

    I was in a similar boat concerning an evaluation. Except my one principal was basically giving the other principal who was doing my evaluation horrible imformation about my classroom management, without ever talking to me about it and NEVER saw me teach. She never once came in to observe my class!

    I hope things work out for you! And at least that person doesn't work there anymore!

    Where was it posted? Like in a public folder? Are there other evals posted or only yours? That is absolutely horrible. I would definitely get the union involved.

    I know there are privacy laws that have been broken. I would contact a lawyer if I were you.

    IT was in a public folder, where we keep things like course maps....everyone is in there daily. It was just a loose document with my name on it.

    Pwhatley, I don't know if it could become a mark, since he is nto with the district......

    No one elses was posted in such a fashion, only mine....in any of the public folders (union already looked)

    Wow...I'm shocked. I can't say anything else. I'm simply dumbfounded.

    You've done what you're "supposed" to do, in contacting the union, which is good. I have no clues what laws would cover that sort of thing.

    Wow, that's amazingly awful. I don't know specifically which law he broke by doing that, but I do know that it IS illegal. The Freedom of Information Act, which journalists use all the time to get info, allows the public to look at any and all documents produced by governmental agencies including schools, but FOIA specifically excludes any type of personnel information including evaluations because those are legally protected and considered to be private between you and your employer.

    I have never practice this type of law and am having trouble remembering it from law school (30 years ago). I will look into it for you if you wish. You definately have a civil case against both the school and the poster of the document.

    Go ahead Brendan, the union is doing the same. I guess they will let me know what move they want to make next.

    The eval that was posted was the worst one from that mess last year, it is as bad as it gets......I just cannot help but think i was personal, posting it like that......what the heck did I ever do to that guy to deserve that?

    That guy is a malicious jerk. I really hope he is not working anywhere where he can be a role model to children. I hope you can sue him and nail him to the wall. And now with all of the technology we have it shouldn't be that hard to prove who originally posted the document.

    Your previous principal definitely broke a law. I hope the union gets on it fast.

    I wouldn't do this. This is why you have a union. The union has a lawyer and if legal action needs to be taken they will hire a lawyer for you (this is why you pay those hefty dues).

    It has already been removed, I did it myself. Yes they have already been able to establish who put it there and when.

    I am just waiting to see what the union does about it.

    I know this answer is late in the game and you've heard it all already - but how awful!

    Last year our district was trying to fight the publication of our incentive pay. Even though salary is public record, they said the incentive pay reflected evaluation of job performance and therefore wasn't a matter of public record - so there has to be a law somewhere about it - our district lawyers plead a case in court.

    Unbelievable! I am stunned. I can't believe this could be ethical. And I can't see what possible good could come of it.
